Title Deed and Buying Process in Bodrum: A Step-by-Step Guide

Finding a home or plot you like in Bodrum is only the beginning. The decisive part is completing the legal and financial steps in the right order, all the way to handover. This guide walks through the entire process from offer to deed transfer and occupancy permit, with practical, Bodrum-specific warnings. The goal is simple: catch the problems that cause headaches later while you are still at the deposit stage.

1. Offer and negotiation

You make a verbal or written offer on the property. Prices in Bodrum vary sharply by location. The per-square-metre gap between the Yalıkavak marina area and the inland neighbourhoods of Bitez or Turgutreis is significant. When you make an offer, look not only at the figure but at what it includes: furniture, appliances, any shared pool and site dues. Room for negotiation depends on how long the property has been on the market and how urgent the seller is.

Tip: before offering, review comparable villas for sale and apartments for sale in the same neighbourhood to set a realistic reference range.

2. Deposit and pre-sale contract

Once you agree, a deposit is usually paid and the terms are put in writing. The critical point: a verbal understanding or a simple receipt will not fully protect you. State the parties clearly, the block-and-parcel (ada-parsel) details, total price, payment schedule, transfer date, and what happens to the deposit if either side withdraws.

  • For higher-value deals, a notarised pre-sale contract is the safest route, and it can be annotated on the deed.
  • Always spell out the refund conditions: will the deposit be returned if the mortgage falls through or if a restriction is found on the deed?
  • Do not hand over cash before verifying the seller's identity and ownership; a bank transfer leaves a record.

3. TAKBİS and deed checks

This is the most skipped yet most vital step. The legal status of the property is checked through TAKBİS (the Land Registry and Cadastre Information System). Things you must verify:

  • Who is the real owner? Is the person selling the one named on the deed, or acting under a power of attorney? If so, it must be notarised and valid.
  • Any annotations, liens or mortgages? A mortgaged property can still be bought, but clearing the mortgage or deducting it from the price must be planned before transfer.
  • Type of deed: condominium title (kat mülkiyeti), construction servitude (kat irtifakı), or a land-share deed? Some older Bodrum buildings still carry kat irtifakı, which can signal that the occupancy permit was never completed.
  • Zoning status: especially if you are buying land for sale, obtain the zoning certificate from the municipality. A plot classified as farmland may not be buildable; coastline setback, olive-grove and protected-site (SİT) restrictions are common in Bodrum.

In coastal and protected-area zones such as Gümüşlük and Göltürkbükü, building permissions are stricter. When buying land, always clarify the question of whether you can actually build with the municipality and, if needed, a surveying engineer.

4. Valuation (appraisal) report

A property valuation report is mandatory for foreign buyers, and banks require one for Turkish citizens using a mortgage. A licensed appraiser inspects the property and sets its official value. This report is both the reference for declaring the correct transfer tax and an independent indicator of whether the property is being sold at an inflated price. Reports have a limited validity period, so it makes sense to arrange it close to the deed appointment.

5. Deed appointment and transfer

Once documents are ready, an appointment is booked with the Land Registry Office (or via the e-appointment system). On transfer day the parties or their representatives attend, fees are paid, and the deed is registered to the new owner. Foreign buyers need a military-zone clearance check and, where required, a sworn translator.

Important warning: the transfer tax must be declared on the true sale price. Under-declaring the price to reduce the fee is common, but it creates legal risk and inflates your capital-gains tax when you sell later. Declaring the real price protects you in the long run.

6. Costs and taxes

  • Title deed fee (tapu harcı): charged on the declared sale price at the statutory rate. Unless agreed otherwise it is split between buyer and seller; in practice the buyer often pays.
  • Revolving fund and service fee: a fixed charge applied during the deed transaction.
  • DASK (compulsory earthquake insurance): required for the deed transfer and utility subscriptions. As Bodrum sits in an active seismic zone, DASK is both a legal requirement and real protection. Do not confuse it with home insurance; DASK covers the structure, while a separate home policy covers contents and other risks.
  • Agent commission: set within the legal framework and stated clearly in the contract.
  • Annual property tax: must be declared to the municipality after transfer.

7. Iskan (occupancy permit)

The iskan is the official permit certifying that the building matches its project and is fit for occupation. Without it, utility subscriptions can be problematic, condominium title cannot be established, and resale becomes harder. In Bodrum, missing occupancy permits are seen especially in older buildings or those with unpermitted additions. Before buying, ask: Does the building have its iskan, and is condominium title established? If not, settle in the contract who bears the cost and responsibility from the outset.

Checklist to avoid problems

  • Is the deed owner the same person as the seller? Is the power of attorney valid?
  • Any mortgage, lien or annotation on TAKBİS?
  • Zoning status and (for land) buildability confirmed?
  • Iskan and condominium title in place?
  • Is the sale price declared at its real amount?
  • Is the DASK policy ready?
  • Any unpaid site dues or property tax?
