By using the BodrumdaBirEv website, you agree to the following terms of service.

1. General Provisions

This website is operated by BodrumdaBirEv. All content, design, and software on the site are protected by copyright.

Royalyat may unilaterally update these Terms of Service and any information and content on the Portal. Updates take effect immediately upon publication on the Portal. Anyone accessing the Portal is deemed to have accepted the current terms.

2. Scope of Service

  • Portal: Bodrumdabirev.com domain name and its subdomains, along with any mobile applications.
  • User: Any natural or legal person accessing the Portal.
  • Account Holder: User who creates an account on the Portal and utilizes its services.
  • Advertiser: Natural or legal person publishing real estate listings on the Portal.
  • Content: All types of information, text, listing descriptions, images, videos, files, and similar elements published on the Portal.
  • Interface: Pages and software components provided by Royalyat that enable Users to conduct transactions on the Portal.
  • Database: The database where Portal content is stored and protected under Law No. 5846 on Intellectual and Artistic Works.
  • Intermediary Service Provider: The role assumed by Royalyat under Law No. 6563 on the Regulation of Electronic Commerce.

3. User Responsibilities

This agreement regulates the terms for visiting the Portal, viewing listings, creating listings, and utilizing the services provided in this context. The Portal is a listing and communication tool. Royalyat is not a party to the properties listed. Investigating the legal and actual status of the property is the responsibility of Users and Advertisers.

4. Privacy

Users are obliged to comply with Turkish law. Legal and criminal responsibility for all transactions and actions belongs to the User.

Account security is the User's responsibility. Royalyat is not liable for damages arising from failure to maintain confidentiality of account information.

Royalyat may request information and documents for verification purposes, such as identity, address, authorization certificates, and property disposal authority. Accounts that fail to provide information or are deemed suspicious may be partially or fully suspended.

5. Disclaimer

Royalyat enables listings and content uploaded by Advertisers to be viewed by Users through the Interface.

Different listing and highlighting options may be offered depending on the location, type, and preferences of listings. These options may be paid.

Reporting services may be provided for listing performance statistics such as views, clicks, and similar metrics.

Royalyat reserves the right to change the scope of services, add new services, temporarily restrict access to content, or delete content.

6. Contact

The Advertiser is solely responsible for all content uploaded. The Advertiser warrants that the listing is accurate, current, complies with legislation, and does not violate personal rights, intellectual property rights, trademark rights, or competition rules.

The Advertiser is obliged to comply with current real estate trade legislation and, if holding an authorization certificate, to ensure it is valid and current. The disposal authority and representation authority over the listed property are the Advertiser's responsibility.

Misleading, incomplete, or false information to consumers cannot be provided, hidden defects cannot be concealed, and content aimed at market manipulation cannot be published.

Royalyat has the right to temporarily remove, delete, or reduce the visibility of content that is unlawful, receives complaints, is misleading, or does not comply with standards, without prior notice.

7. Prohibited Uses

Access to all or part of the Portal using robots, software, or similar automated methods, data mining, screen scraping, reverse engineering, violation of API keys or security mechanisms is prohibited.

Unauthorized acquisition, processing, or transfer of data belonging to other users to third parties is prohibited.

Listings cannot contain discriminatory statements based on gender, race, color, language, religion, belief, sect, ethnic origin, wealth, birth, marital status, health condition, disability, age, or similar grounds.

8. Fees, Billing, and Collection

Portal services may be free or paid. For paid services, current fees, terms, and campaigns are announced on the Portal.

Royalyat may unilaterally change fees. Changes apply to services purchased after the announcement date.

Subscription and similar periodic plans are billed at the fees in effect during renewal periods. If the User fails to fulfill payment obligations on time, the service may be suspended and legal interest may be applied in case of delay. Royalyat reserves the right to offset and set off its receivables.

9. Intellectual Property and Content License

The design elements, Interface, software, codes, texts, images, and Database of the Portal are subject to the intellectual property of Royalyat or its licensors under Law No. 5846. Without Royalyat's express written permission, Users may not resell, process, copy, distribute, display, or create derivative works from these elements.

The Advertiser grants Royalyat a worldwide, perpetual, free, transferable, sublicensable, and non-exclusive license. This license covers all forms of use necessary for operating and promoting the Portal, including storage, reproduction, public transmission, processing, reformatting, resizing, watermarking, and use for advertising, promotion, and marketing purposes. Royalyat does not claim ownership over original content.

The Advertiser warrants not to violate third-party rights over uploaded content. In case of third-party rights claims, the Advertiser will compensate Royalyat for any damages, expenses, and administrative fines incurred.

10. Personal Data and Commercial Communications

Personal data is processed in accordance with Law No. 6698 on the Protection of Personal Data. Details are regulated by the Disclosure Text and Cookie Policy. Functional, performance, and advertising cookies may be used during Portal visits. Preferences can be managed at any time.

If the User has given consent for electronic messages, they agree to receive campaign and informational messages about products and services. Consent can be withdrawn at any time.

11. Intermediary Service Provider and Notification Obligations

Royalyat is an intermediary service provider under Law No. 6563. In accordance with relevant legislation, log records and other technical data are stored for statutory periods and may be shared upon requests from authorized authorities.

Royalyat is not liable for damages caused by content providers to third parties. Requests from authorized authorities to block access or remove content will be complied with.

12. Suspension, Termination, and Service Modification

Royalyat has the right to partially or fully suspend accounts, stop services, remove content from publication, or immediately terminate the agreement in cases of legal violations, security risks, fake accounts, suspicious transactions, payment issues, or third-party rights violation complaints.

Users may close their accounts at any time. Periodic fees for paid services are non-refundable. Mandatory refunds arising from legislation are reserved.

13. Disclaimer and Limitation of Liability

The accuracy, currency, and legal compliance of listings and content on the Portal are not warranted by Royalyat. Royalyat is not a seller, lessor, authorized representative, appraiser, evaluator, intermediary institution, or consultant.

Royalyat is not liable for indirect damages, loss of profit, loss of reputation, data loss, and consequential damages. Royalyat's total liability for direct damages arising from its slight negligence, excluding gross negligence, is limited to the total amount paid by the User to Royalyat in the twelve months preceding the relevant event. Liability arising from law for damages resulting from intent or gross negligence cannot be limited.

Limitations contrary to mandatory provisions do not apply to Users with consumer status.

14. Indemnification and Recourse

The User agrees to indemnify Royalyat for third-party claims, administrative fines, and all damages arising from legal obligations resulting from use of the Portal in violation of these terms.

15. Force Majeure

Natural disasters, war, mobilization, fire, strike, lockout, infrastructure and internet failures, power outages, pandemics, legal regulations, court and administrative decisions, and events beyond Royalyat's reasonable control that cannot be prevented are considered force majeure. Royalyat cannot be held liable for delays or inability to fulfill obligations during force majeure.

16. Notification, Electronic Communication, and Evidence Agreement

Notifications are made through notification areas on the Portal or methods accepted by the User on their account screen. Notifications made to contact channels registered on the Portal are deemed written notifications. The parties accept Royalyat's book records, computer records, log records, emails, and system records as conclusive evidence.

17. Assignment and Transfer

Royalyat may assign the rights and obligations arising from this agreement to its subsidiaries, group companies, or acquiring third parties. The User may not transfer the agreement to third parties.

18. Applicable Law and Jurisdiction

Turkish substantive law applies even if there is a foreign element. Conflict of laws rules do not apply. Istanbul Central (Çağlayan) Courts and Enforcement Offices have jurisdiction over disputes arising from this text. Mandatory provisions regarding mandatory application procedures for Users with consumer status are reserved.

19. Effectiveness

These Terms of Service take effect on the date they are published on the Portal. Anyone using the Portal is deemed to have read and accepted the terms.
